Catering/Food Business- Registration of premises that serve food

The majority of food businesses under the control of the Environmental Health Services (EHS) of the HSE do not require a licence - they merely have to notify the relevant EHS.
However, a small number of businesses dealing with food of animal origin are dealt with by the EHS and these require prior approval by the EHS before they can commence trading. It should be noted however, that this requirement is through Department of Agriculture, Food and the Marine legislation.

CITES is an international agreement between governments. 180 States or Parties are members of CITES (including all EU Member States).
Its aim is to ensure that international trade in specimens of wild animals and plants does not threaten their survival. It covers approximately 35,000 species, which are listed in three Appendices, according to the degree of protection required.
All import, export, re-export and introduction from the sea of species covered by CITES, as well as certain regulated trade within the EU, must be authorised through a licensing system. Annually wildlife trade is very diverse and estimated to be worth billions of Euros. Trade ranges from live animals and plants to a vast array of wildlife products derived from them, including food products, exotic leather goods, wooden musical instruments, timber, tourist curios and medicines.

Commencement Notice
Persons intending to carry out certain building works are required to submit a Commencement Notice in advance of the commencement of the proposed building works.

The purpose of a Commencement Notice is to notify the relevant building control authority that a person intends to carry out either building works or a material change of use to a building to which the Building Regulations 1997 apply.

The requirement is set out in Section 6 of the Building Control Act 1991 (Number 3 of 1991). The process is set out in Part II of the Building Control Regulations 1997 – 2014. Both the Act and the Regulations can be found on www.irishstatutebook.ie.

Construction Products -Notifications
Persons in Ireland wishing to operate as a notified body for construction products are required to complete an application for notified body status.

The purpose of a notified body for construction products is to ensure that the third party tasks in relation to the assessment and verification of constancy of performance of construction products are carried out in accordance with the requirements of the relevant harmonised European standard.
This will allow the manufacturers of construction products to make a Declaration of Performance and apply the CE marking to their products as required under Regulation (EU) No. 305/2011 of the European Parliament and of the Council laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC.

The Irish National Accreditation Board undertakes accreditation and monitoring of notified bodies in Ireland. Bodies seeking to be notified for the purpose of the Regulation (EU) No. 305/2011 of the European Parliament and of the Council laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC should first apply to the Irish National Accreditation Board for the accreditation relevant to the services they wish to provide.

Contained use of Genetically Modified Micro-organisms

The Environmental Protection Agency is Ireland’s competent authority under Directive 2009/41/EC, which is a re-cast of EU Directive 98/81/EC, on the contained use of genetically modified micro-organisms (GMMs).
Detailed procedures concerning the authorisation process are set out in the Directive and the Genetically Modified Organisms (Contained Use) Regulations 2001 (S.I. No. 73 of 2001) as amended by Genetically Modified Organisms (Contained Use) (Amendment) Regulations 2010 (S.I. No. 442/2010).
The protection of human health and the environment requires that due attention be given to controlling risks from the contained use of GMOs and GMMs. The authorisation scheme is as per the procedure set out in the Directive.
Service providers who intend to carry out a contained use of a GMO/GMM are required to notify and obtain prior consent from the competent authority. They are also required to maintain written records of work and to notify the competent authority of certain new information as it becomes available.
